In this action plaintiff alleges violation of 42 U.S.C. Â§ 405(h) and jurisdiction under 28 U.S.C. Â§ 1361. For the reasons stated below, we reverse the order of the district court granting the Secretarys motion for summary judgment, and remand the case to be dismissed for lack of subject matter jurisdiction.
